These Terms of Service ("Terms") are an agreement between you and Fort ("Fort", "we", "us") for your use of the Fort app and the website fortapp.live (together, the "Service"). By creating an account or using the Service you accept these Terms, our Privacy Policy, and, when you buy something, the Top-up Agreement and the Membership Agreement. If you do not accept them, do not use the Service.

1. Who can use Fort

• You must be at least 18 years old, or the age of legal majority where you live if that is higher.
• You must be legally able to enter into this agreement and not be barred from the Service by law or by an earlier decision of ours.
• You use the Service for yourself. Accounts are personal and may not be sold, rented or given to someone else.

2. Your account

• Give accurate information when you register and keep it up to date.
• Keep your sign-in details secret. You are responsible for what happens under your account. Tell us immediately if you think someone else has used it.
• Your nickname, avatar and profile must not impersonate another person or organisation, and must not contain content these Terms prohibit. We may change or remove them if they do.
• You can delete your account at any time in the app settings. Deletion is permanent.

3. Community rules

Fort is a place for live conversation. To keep it safe, you must not use the Service to do any of the following, in voice, text, pictures, profile details or any other form:

• Break the law, or encourage or help others to do so.
• Harass, threaten, bully, stalk, defame or humiliate anyone, or incite hatred or violence against people because of who they are.
• Share sexually explicit or pornographic content, offer or ask for sexual services, or sexualise minors in any way. Any content that exploits or endangers children is removed and reported to the authorities.
• Share content that promotes terrorism, self-harm, illegal drugs, weapons or gambling.
• Deceive other users: scams, fake giveaways, impersonation, phishing, or asking for money or account details under false pretences.
• Share someone else's private information without permission.
• Infringe copyrights, trademarks or other rights of others.
• Send spam or unsolicited advertising, or move users to other platforms for commercial purposes.
• Buy, sell or trade accounts, coins or virtual items outside the Service, or use unofficial top-up channels.
• Use cheats, bots, modified versions of the app, or automated means to access the Service; probe, scan or attack our systems; or interfere with other users' use of the Service.
• Create several accounts to abuse promotions, rankings or rewards, or to evade a ban.

Room owners and administrators are also responsible for keeping order in their rooms and for acting on breaches they become aware of.

4. Moderation, blocking and reporting

• You can block any user and report users, rooms and content from inside the app. We review reports and act on those that show a breach.
• We may review content and activity with automated tools and human moderators. We are not obliged to monitor everything, and we are not responsible for content posted by users.
• If you break these Terms we may, depending on how serious the breach is, remove content, issue a warning, mute you, remove you from a room, restrict features, suspend the account for a period, or close it permanently. For serious breaches we may act without notice and may ban the device.
• If you think a decision was wrong, contact us and we will review it.

5. Your content

You keep the rights you have in the content you create. So that we can run the Service, you grant Fort a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, display and distribute that content within the Service and to promote the Service. The licence ends when the content is deleted, except where it has been shared with others who have not deleted it, or where we need to keep it for legal or safety reasons.

You confirm that you have the rights needed to share the content you post and that it does not break these Terms.

6. Coins, gifts and other virtual items

• Coins, gifts, decorations, badges and other virtual items are licensed to you for use inside the Service. They are not money, have no cash value, and cannot be exchanged for money or transferred outside the Service except through features we expressly provide.
• Purchases are governed by the Top-up Agreement, and memberships by the Membership Agreement.
• A gift you send is delivered immediately and cannot be recalled.
• Reward and host programmes, where offered, follow the rules published for them in the app.
• If an account is closed for a breach of these Terms, the virtual items in it are forfeited.

7. Our rights in the Service

The Service, including its software, design, logos and content we provide, belongs to Fort or its licensors. We give you a personal, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, modify, reverse-engineer or redistribute any part of the Service except where the law expressly allows it.

8. Third-party services

The Service uses and links to services run by others, such as app stores, sign-in providers and payment providers. Their terms apply to your use of them, and we are not responsible for them.

9. Changes and availability

We keep improving the Service, so features may be added, changed or removed. We try to keep the Service available, but it may be interrupted for maintenance, updates or reasons outside our control. We may stop providing the Service, or any part of it, and will give reasonable notice where we can.

10. Ending the agreement

You may stop using the Service and delete your account at any time. We may suspend or close your account if you break these Terms, if the law requires it, or if your use creates risk for other users or for us. The sections that by their nature should continue, such as the licence to your content already shared, disclaimers and limits of liability, remain in force afterwards.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties about it, whether express or implied, including that it will be uninterrupted, error-free or fit for a particular purpose. You interact with other users at your own risk. We do not vet users and are not responsible for what they do, online or offline.

12. Limitation of liability

To the fullest extent the law allows, Fort is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, or the rights you have as a consumer under the law of the place where you live.

13. Your responsibility to us

If someone brings a claim against Fort because of content you posted or because you broke these Terms or the law, you agree to cover the losses and reasonable costs that result, to the extent the law allows.

14. Changes to these Terms

We may update these Terms. The date at the top shows when they last changed. If a change is significant, we will tell you in the app or by another suitable means before it takes effect. If you continue to use the Service after a change, you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

15. General

• These Terms are governed by the laws of the place where the operator of the Service is established, without affecting the mandatory consumer protections of the place where you live. Disputes should first be raised with us so that we can try to settle them amicably.
• If part of these Terms is found to be unenforceable, the rest stays in force.
• If we do not enforce a provision, that is not a waiver of it.
• These Terms are published in several languages. If the versions differ, the English version prevails.
